These Terms of Service ("Terms") govern your use of PhraseMine ("we," "us," or "our"), a market research platform headquartered in the State of Delaware, USA. By creating an account or using PhraseMine, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using PhraseMine, you confirm that you are at least 18 years old and agree to comply with these Terms. If you do not agree, you must not use the platform.

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and current information during registration
• Notifying us promptly if you suspect unauthorized access to your account

Acceptable Use

PhraseMine is designed for legitimate market research purposes. You agree not to:

• Use the platform for automated data collection and analysis, abuse, or any purpose that violates applicable laws
• Attempt to circumvent rate limits, security measures, or access controls
• Use collected data to harass, dox, or otherwise harm individuals
• Redistribute collected content in a manner that violates Reddit's terms of service or applicable copyright law
• Share your account credentials with others or operate multiple accounts

Intellectual Property

Your data. You retain full ownership of the research briefs, notes, and excerpts you create within PhraseMine. We do not claim any intellectual property rights over your research data.

Our platform. The PhraseMine platform, including its source code, design, branding, and AI-generated outputs (search queries, theme analysis, saturation reports), is owned by PhraseMine. You may not copy, modify, or redistribute any part of the platform without our written permission.

Third-Party Content

PhraseMine retrieves publicly available content from Reddit and other public sources. This content is owned by its respective authors. We do not endorse, verify, or take responsibility for the accuracy or legality of third-party content displayed on the platform. Your use of such content is subject to Reddit's terms of service.

Service Availability

PhraseMine is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the service at any time without prior notice. We are not liable for any downtime, data loss, or service interruptions.

Limitation of Liability

To the fullest extent permitted by law, PhraseMine and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes, but is not limited to, loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Disclaimer of Warranties

PhraseMine is provided without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated outputs are accurate, complete, or suitable for any specific purpose.

Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users or the platform. You may delete your account at any time. Upon termination, all your data will be permanently deleted in accordance with our Privacy Policy.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of PhraseMine shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration administered under the rules of the American Arbitration Association, with proceedings held in the State of Delaware. Each party shall bear its own costs, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Your continued use of PhraseMine after changes constitutes acceptance of the updated Terms.
